California fans of Madonna may be surprised that her son does not want to live in New York with her anymore, according to court sources and the teenager’s attorney. Instead, he wants to remain in London, where he is visiting with his father, director Guy Ritchie.
On Dec. 21, litigation was initiated in London, where the 15-year-old made it clear that he wants to stay there. Sources say that the teen’s attorney has been holding onto his passport. At a hearing in Manhattan on Dec. 23, the Supreme Court justice asked the teen’s attorney if this was true, and the attorney confirmed it.
The justiceordered the teen to return back to New York in time for school to resume after Christmas break and to talk to his mother about where he wants to live. The judge said that the court will appoint an attorney to handle the teen’s case in New York.
Sources did not comment on why the teenager does not want to live with Madonna. However, she has made a couple of embarrassing Instagram posts about him over the last two years. The first was in January 2014, and the second was in May 2015. Additionally, he traveled with Madonna for her world tour for several months this year.
After custody decisions are made in a divorce settlement in one state, that state typically has jurisdiction over any modifications that are made to the custody order. Under the Uniform Child Custody Jurisdiction and Enforcement Act, court jurisdiction goes to the child’s home state, which is where the child has lived with a parent for six consecutive months, or the state that has the most connection with the child and is the resident state of one parent. Parents who are unsure about which state has jurisdiction in their custody case could ask a family law attorney for help.
