Does shared parenting time affect the amount of child support in North County San Diego divorce cases?  What is the difference between legal and physical child custody and how will this work in your case?

There are two types of child custody associated with a divorce in Carlsbad: Legal Custody and Physical Custody.  Physical custody is associated with the quality time the child will spend with each parent.  Parenting time is an agreement or order concerning physical custody.  Legal custody regards the right to make important decisions in your child’s life including but not limited to:

  • Religion
  • Healthcare

Family Law Courts in the State of California are concerned with one primary thing: the best interest of the child.  Child support is rooted in California family law which assigns each parent a duty (a firm obligation) to provide support for their children.  The purpose of child support is to ensure a child in a divorce has the financial support necessary to meet these standards of care.

How does shared parenting time affect the amount of child support?  If each parent will be providing equal amounts of food, clothing and shelter why is child support still an issue?  The good news is Carlsbad Family Law Courts are seeking an equitable solution in the best interests of the child.

The law requires a “guideline” calculation of child support based upon a variety of factors unique to each parent.  Once guideline support is established, the Court will consider all factors including the previous lifestyle of the family, as well as healthcare and the financial (income) balance between the parents after divorce.  The amount of time the child will spend with each parent absolutely influences the Judge’s decision regarding child support.  The balance of legal custody will also be a consideration.
