Complex Property Division in a California Divorce

California generally treats assets and debts acquired during marriage as community property, meaning they belong to both spouses unless an exception applies. Separate property may include qualifying assets owned before marriage or received individually as a gift or inheritance. Transactions during the marriage, however, can complicate that classification.

A complex estate may include real property, privately held businesses, investments, retirement benefits, executive compensation, and trust interests. Some assets may contain both community and separate property components. We examine financial records, title histories, transaction documents, and valuation issues to prepare property claims under the California Family Code.

When community and separate funds have been mixed, resolving the dispute may require tracing contributions, analyzing appreciation, evaluating reimbursement claims, and determining how related debts should be treated.

Child Custody, Support, & Family Safety

Child custody orders commonly address legal decision-making and parenting time. A detailed parenting plan may also cover transportation, school schedules, holidays, travel, communication, and procedures for resolving future disagreements.

Child support and spousal support involve different legal standards and financial considerations. The analysis may account for income, earning capacity, expenses, assets, debts, parenting time, and the needs of a child or supported spouse, subject to California law and the evidence presented.

When domestic violence or immediate safety concerns arise, we can address protective orders, custody implications, communication restrictions, and safe participation in court proceedings. These cases call for prompt preparation and close attention to the allegations and available evidence.

Choosing Between Mediation & Litigation

Mediation allows the parties to negotiate disputed issues with a neutral mediator and may give them greater control over proposed terms. Any resolution should be based on complete financial information and informed decision-making.

Mediation isn’t appropriate for every dispute. Litigation may be necessary when urgent orders are needed, financial disclosure is incomplete, safety is at risk, or the parties can’t resolve custody, support, or property issues. We tailor our preparation to the chosen path and represent clients in negotiated proceedings and in court.
